Judge David RossFeb. 12

Ashley K. Jones, 29, of Crescent Street, Athol. Charged with abuse prevention order violation. First appearance at trial defendant was not held, but event resolved. Sufficient facts found, but continued without a finding until Feb. 11, 2020. Special conditions to stay drug and alcohol free and subject to screenings.  

Feb. 11

David P. Karras, 39, of Beacon Street, Athol. Charged with resisting arrest and assault and battery on a police officer.  Pretrial hearing found defendant not held, but event resolved. Count 1 dismissed upon the request of the Commonwealth. Karras plead guilty to assault and battery on police officer and was placed on probation until February 8th 2021. 2½ years in the Franklin County House of Corrections, 90 days direct (stayed until Feb. 25). Balance sentence served in 2 years. Special conditions included mental health treatment, substance abuse treatment, monitoring unit and to stay drug and alcohol free with screenings.  

Christopher Demeulle, 21, of Boutelle Street, Fitchburg. Charged with violation of abuse prevention order. Arraigned and held, released on personal recognizance. Pretrial hearing is set for April 8.

Damien J. Cox, 18, of Prospect Street, East Longmeadow. Charged with OUI-drugs, class D drug possession, person under 21 possesses liquor and motor vehicle lights violation. Arraigned and held, released on personal recognizance. Pretrial hearing is set for March 29.

Andrea Robertson, 35, of Sanders Street, Athol. Charged with uninsured motor vehicle. Arraigned and held. Dismissed upon the request of the Commonwealth.

Anthony M. Cutaia, 26, of South Main Street, Orange. Charged with OUI-liquor, intoxicated licensee carrying firearm, and improper storage firearm. Held, admission to sufficient facts found, but continued without a finding until Feb. 10, 2020 with special conditions on count 1. Defendant plead guilty on count 2 and was placed on probation until Feb. 10, 2020 with special conditions. Count 3 was dismissed at the request of the Commonwealth.

Daniel Rivera, 19, of Main Street, Gardner. Charged with distribute class D Drug.  Arraigned and held, released on personal recognizance. Pretrial hearing set for April 5.

Feb. 8

Evan Mirbel, 30, of Metropolitan Court, Athol. Charged with 3 counts of violation of abuse prevention order.  Pretrial hearing, first two counts sufficient facts found, but continued without a finding until February 7th, 2020.  Count 3 dismissed upon request of Commonwealth. Charged with assault. Pretrial hearing, sufficient facts found, but continued without a finding until Feb. 7, 2020.  

Feb. 5

Kyle M. Thibault, 33, of Main Street, Athol.  Charged with trafficking in 18 grams or more, less than 36 heroin/morphine/opium.  Class b and e drug possession. Arraigned and held, 10,000 cash bail. Pretrial hearing is set for March 4.

Judge John P. McKennaFeb. 8

Joshua W. Gleason, 37, of Prospect Street, Orange. Charged with assault and battery on family/household member. Defendant plead guilty at a jury trial. $100 fine was assessed.  

Jackie C. Stafford, 68, of Morton Meadows, Athol. Charged with shoplifting by asportation and larceny under $1200 by false pretense. Pretrial found the defendant not held, but event resolved.  Count 2 was dismissed at the request of the Commonwealth. Defendant was placed on pretrial probation until May 7, for count 1 and ordered to complete the Millenium Program.

Michelle E. Fortin, 27, of East Main Street, Athol. Charged with class A drug possession. Arraigned and held, 100 cash bail.  Pretrial hearing is set for March 29.

Randy K. Favreau, Jr., 24, of Nina Pierce Circle, Orange. Charged with class A drug possession.  Arraigned and held, released on personal recognizance. Pretrial hearing is set for March 29.

Thomas C. Woods, 46, of Southern Heights Drive, Vernon, Vermont. Charged with operating a motor vehicle with license revoked and license not in possession. Pretrial hearing found defendant not responsible for count 2 and admission to sufficient facts found on count 1. Continued without a finding until May 7.

Ted F. Dagostino, 25, of Old Long Plain Road, Montague. Charged with 2 counts of trespass, breaking and entering daytime felony, breaking and entering misdemeanor and attempt to commit crime. Arraigned and held, released on personal recognizance. Pretrial hearing is set for March 29.

Jordan J. Barber, 28, of Athol. Charged with class a drug possession, class b drug possession and possession of ammunition without FID card. Pretrial hearing found count 2 dismissed at the request of the commonwealth. Admission to sufficient facts found, but continued without a finding until Feb. 7, 2020, on counts 1 and 3.

Stephen P. Gebo, 52, of Ridge Road, Athol. Charged with OUI-liquor, negligent operation of a motor vehicle and operating a motor vehicle with a suspended license. Count 1 was Nolle Prosequi. Count 2 admission to sufficient facts found, but continued without a finding  until Feb. 7, 2020. Count 3 was dismissed upon the request of the Commonwealth.

Horace P. Liversidge, Jr., 43, of Wendell.  Charged with OUI-liquor, negligent operation of a motor vehicle, possession open container of alcohol in motor vehicle and marked lanes violation.  Arraigned and held, released on personal recognizance. Pretrial hearing is set for March 18.

Luis A. Otero, 49, of Harrison Avenue, Springfield. Charged with OUI-drugs, negligent operation of motor vehicle, marked lanes violation, motor vehicle lights violation and not in possession of registration. Arraigned and held, $250 cash bail. Pretrail hearing is set for March 18.

Russell S. Johnson Jr., 74, of Neilson Road, New Salem. Charged with assault and battery.  Arraigned and held, released on personal recognizance. Pretrial hearing is set for March 18.
